Thank you for visiting enokaclothing.com. Please read the following terms and conditions carefully before using the web site.  By ordering products from enokaclothing.com, you are agreeing to be bound by the terms & conditions set out in the following paragraphs. If you do not agree with these terms and conditions without modification, then you should not place an order with us.

Pricing

We make every effort to ensure the prices are correct, however occasionally errors may occur where prices are incorrectly displayed or change as a result of circumstances beyond our control. If for any reason either the price displayed on enokaclothing.com is wrong or the item is out of stock we will notify you of the correct price(s) or advise you of the next shipment delivery date. If you should not wish to purchase the product concerned at that price or at the delayed delivery time you will then be given the option of choosing another item or having a full refund. All prices are in US dollars.  Enokaclothing.com uses PayPal as the credit card payment gateway and cards accepted are dependent on what is available under PayPal's Terms and Conditions. Items offered at a special price are available at featured prices only while stocks last and only for the period quoted. It is at the sole discretion of Enoka Ltd to continue or discontinue the featured pricing level, after the specified date.

Delivery

We endeavor to deliver on time, but we will not be held liable for any loss caused through late delivery. Overseas deliveries may be subject to local taxes, import duties or customs clearance charges, these costs must be borne by you. You are the importer of all goods and it is your responsibility to comply with all regulations and laws in your country relating to the importing of goods and the transferring of money. Enokaclothing.com does not accept responsibility for items being delayed through customs or security checks.

Deliveries by UPS are made during your local business hours, with parcels requiring a signature. If there is no one at home, a card will be left to re-arrange delivery, or please supply an alternative address that can receive the parcel on your behalf. Deliveries over the busy Christmas period could be extended by a number of days. When you select UPS as your delivery service you will automatically be sent a tracking number in the dispatch email you receive following your order. You can then visit www.ups.com and enter this tracking number in the relevant field to check the status or your delivery while it is in transit.When you select Post Priority as your delivery service your package will be sent registered Airmail. You will not automatically receive a tracking number in your dispatch email. However if you wish to check the status of your package while in transit please email us at sales@enokaclothing.com.

EC Territories

All deliveries in the following EC countries are free of tax and Duty on delivery: Austria, Belgium, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxemborg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and the UK.

Other Territories
Orders to be delivered to all other countries (than listed above) are liable for customs duties and import tax relevant to your country. These charges, if applicable, will be payable either on import or delivery of the goods.

Privacy

Enoka Ltd would like to reassure you that the information you supply us with when placing an order is private, confidential and secure. We will not pass on or sell any of that information to a third party. Delivery companies will be supplied with information, where the information supplied will only relate to the delivery of goods. We may monitor transactions to make our site more efficient.

Security

Enokaclothing.com uses a trusted, online, real-time Yahoo merchant banking system with a 128 bit SSL (Secure Socket Layer) encryption on their servers to ensure your credit card details are safe. SSL digital certificate provider gives our customers the strongest certificate services available. Your credit card information is encrypted while traveling the Internet.

Ordering
When you place an order to purchase any products from enokaclothing.com, we will send you an email confirming receipt of your order and containing the details of your order. If there is any discrepancy between the information sent in your order and that shown on the confirmation email, you must let us know immediately at sales@enokaclothing.com. Your confirmation message is absolute proof of the terms upon which you are offering to purchase the product from us.

Your order will only be accepted by us when we send you an email containing dispatch advice.  Only the products confirmed in the dispatch confirmation message form the subject of our contract.  Any products you order which are not included in the dispatch message will have been omitted for either, reasons stated by Enoka, for example, stock not available, or for reasons that you, the customer have requested following the order.

Colors

Whilst every effort has been made to present the true likeness of the product colors, variations may occur on different screen resolutions and qualities. We therefore cannot guarantee colors will be as seen on your screen.

Returns

Upon receipt of an ordered product, the customer has a 14 day period in which to return the product in an unused condition should you decide it is not suitable or is faulty. Returned items must be in original packaging, unused, and with all price tags attached. The customer must notify Enoka Ltd immediately by email to sales@enokaclothing.com stating that they wish to proceed in returning the goods, with a valid reason, for our evaluation. We will not accept any items returned for any reason without our authorization. Where you are withdrawing from your purchase and there is no error on our part, you will be responsible for the cost of returning items to our warehouse in Austria, using a recorded delivery service which requires a proof of delivery. Returned goods can be refunded in full for the purchasing price or can be exchanged for a product of same value or as part payment of a more expensive product(s). In the case where Enoka Clothing is at fault, where we have sent the incorrect product, size or color or the product is damaged or faulty then we will refund the cost of postage to return those items to us. 

General

Whilst enokaclothing.com has taken reasonable precautions to minimize the risk of viruses and computer corruption, we will not accept liability for any damage caused to software, computers or computer equipment.

In these terms and conditions, where reference is made to, ‘the customer’, ‘you’, ’your’, this will mean the person(s) ordering goods from enokaclothing.com and where reference is made to, ‘us’, ‘we’, ‘our’, this stands for Enoka Ltd.These terms and conditions are governed by and construed in accordance with the laws of Gibraltar and parties hereby submit to the exclusive jurisdiction of the Courts of Gibraltar for determination of any dispute hereunder.

Enokaclothing.com is a dynamic and as a result these terms and conditions may be subject to change from time to time. You will be subject to the terms and conditions current at the time you use this site.
